§17200 Practice
Life After Prop. 64

Proposition 64 effected the most sweeping change in Section 17200 practice in over 40 years. It eliminated the "unaffected plaintiff" standing rule that had prevailed for decades. And it eliminated "representative" actions – the so-called "nonclass class" action. But Proposition 64 has left many important questions unanswered:

  • Does Proposition 64 require proof of "reliance"?
  • What does the "injury in fact" standard mean?
  • What test of "unfair" applies in consumer cases?
  • Is the "likely to mislead" test of "fraudulent" business practices overruled?
  • What kinds of losses qualify for “restitution”?
  • Have "omissions" cases changed under the Prop. 64 standard?
  • How are private injunction actions affected?
  • Did Prop. 64 narrow or eliminate competitor cases?
  • What must be shown to get a UCL class certified?

Whether you represent plaintiffs or defendants, businesses or consumers, you need to know about the UCL's extraordinary reach and how it has been affected by Proposition 64. You'll hear it first-hand from our expert panelists - the principal author of Proposition 64, the former President of the Consumer Attorneys of California, and our moderator, Justice Croskey.
